Gambling and Games of Chance



The Ohio Division of Liquor Control is charged with the responsibility for controlling the manufacture, distribution, and sale of all alcoholic beverages in Ohio. The Division's primary authority is the issuance and renewal of liquor permits to businesses throughout the state.

The Division has no regulatory or enforcement authority regarding games of chance or gambling, and cannot provide any information to permit holders as to the legality of any activities on a liquor permit premises that may be considered games of chance including, but not limited to, all forms of poker (including Texas Hold 'Em), bingo, tip tickets, and slot machines. However, permit holders should review the Ohio Liquor Control Commission's administrative rule, OAC 4301:1-1-53 entitled "Gambling, gambling devices and promotional contests." The Division also suggests that permit holders with questions or concerns regarding games of chance or gambling should consult with private legal counsel to help ensure that the operation of their business is in compliance with Ohio law.
